Jury Duty - Dealing with the Often Unfair Burden of Civic Responsibility

By Shirley Ann Parker I can only speak of California when referencing contemporary jury duty, though I’ve been called to serve in another state in the past, with equally irritating circumstances to deal with. Until the US Court system treats jurors with the respect they deserve, a jury of one’s peers will never meet its intended ideal. By that standard, anyway, a drug dealer would merit being tried by a jury of other druggies! Frankly, I think the existing jury system itself would be a major deterrent to crime. Who would want to be tried by a jury of individuals, most of whom didn’t want to be there in the first place? Why not? Consider this: their employers don’t pay them during their attendance to civic duty; their families are suffering in their absence; the jurors themselves can’t wait to escape the dancing attorney acts. We would be far better served by professional jurors who understand the law and who have also received formal training in compassion from the school of hard knocks. At least a mixed jury of professionals and greenies would ensure real justice from the system. Added to California’s other mind-boggling woes, which are still taking center stage of late, is a chronic shortage of qualified jurors, particularly in Los Angeles County. No doubt that’s aggravated by a higher crime rate in our overcrowded population, which in itself creates an even more clogged docket. Though the state has completed the phase-in of One Day-One Trial, the general public still doesn’t seem to understand that if they are selected to serve on a jury, One Trial supersedes One Day. A prospective juror is on call for the entire week stipulated in the Jury Summons, reports on the day he or she is ordered to report, and serves for the length of the assigned trial. The only exception is being formally dismissed by the presiding judge on the day the juror is called, or possibly later in an emergency. There is no state payment at all for the first day of jury service. If you are assigned to a trial, from the second day onwards, California now pays the grand sum of $15 a day plus one-way mileage from home to the courthouse, assuming you live in the center of the town from which they’re measuring. Otherwise, you come up a few miles short. This is the first increase in 45 years. It about covers the cost of gas and your lunch, unless you backpack that in and risk putting it in the refrigerators in the jury assembly room. Some courthouses have no lunch facilities; others provide only limited free parking, if any at all. And, you creative folks, leave the knitting and crocheting and embroidery at home. Nothing that could be used as a weapon is allowed inside the building, let alone in the courtroom. Be aware that the TVs in the jury room might not work if the courthouse is being remodeled. No TV antenna and no cable service. Bring your headphones and your own CDs or tapes, or a book that will hold your interest. (Outside of L.A. County, some jury rooms actually have computers with Internet access.) In case you haven’t been called to jury duty lately, the system doesn’t give a hoot about financial hardship nowadays, not even if you’re self-employed, or your employer won’t pay you to serve. Neither does it care that you were scheduled to report to a paid training course, so you could finally get your first job since September 11, 2001. As we were recently instructed, “a five-day trial isn’t considered a hardship to anyone”. Well, excuse me for disagreeing! As far as health problems are concerned, if you’re under the age of 70 and you’re breathing, you can serve. You’ll have to hope your doctor’s signature will excuse you, but often, it does not. Believe me, no courtroom wants a juror with multiple health problems, but they do their best to make you look like a liar during the Inquiry process. As to the type of juror that is sought, the preference seems to be for a prospective juror who is not an independent thinker. Of course, it’s normal to want a panel that is sympathetic, but a balanced jury is more just, when such can be seated. Defense attorneys, in particular, like a juror who can be manipulated into believing their spin on events. That goes without saying. Every client wants an attorney who is on their side, else why bother with legal representation? Any fool can represent herself in a courtroom, if she so desires.* Even so, anyone who appears to be an uneducated, quiet little housewife who can be easily swayed, is likely to be selected for a jury. Woe to the attorneys who make that mistake, however! Little old ladies in particular can be “dangerously” opinionated. It isn’t just good things that come in small packages. The best advice that can be given is: Yes, do your civic duty if at all possible. Heaven knows we need conscientious, caring jurors. Read your instructions. Maintain decorum. Dress conservatively. Do not show up late, at least not without telephoning first to explain your crisis. Cooperate with the court at all times. NEVER mouth off at or otherwise insult the judge. He or she reigns supreme in that courtroom. Answer questions honestly. Don’t let attorneys make you look like an idiot. *[There is always the exception, of course. Sometimes, such short notice is deliberately given, so that the individual has to show up alone. There isn't time to find and consult with an attorney. I'm talking less than 48 hours! New Control Techniques for Those Pesky Moles!

By Mark Dotson For many years there was a one size fits all kind of approach to mole control. The scissor or Victor Out-of-Site trap was the king of the hill for catching moles. Recently there have been some new innovations in the control of moles. A recent addition to the trap family is the No-Mole product. The No-Mole is a totally different design with a type of jaws that form the shape of an L. A unique trigger mechanism in the shape of an oval with a flat side on it fits between two long spring rods. When this trap is placed in the tunnel, the mole pushes the trigger mechanism and is captured in the trap. The beauty of this trap is that it sits entirely underground and out of the reach of children and pets. The traps are very inexpensive and lightweight and can be set without the use of any tools. Abra Cadabra

By Shael Siegel Halacha (Jewish law) is the bridge over which the Torah moves from the written word into the living deed. There tends to be a built in tension between the two, because whereas the Torah is the written word and static, life is organic, forever in motion and evolving. There are many Jewish laws which were rendered as such resulting from the Talmudic ruling that minhag din hoo (custom has the power of law). Many of the customs and traditions in Jewish life which we may understand as halachic in nature and origin are merely a reflection and expression of the society and culture which it sought to bridge. What happens when society continues to evolve and no longer is in need of certain customs and traditions that have evolved into halachah from earlier times? Do they fall by the way side since they no longer are meaningful or are they to be practiced with the same intensity as in the past when they genuinely reflected its culture and thus had relevance? Many halachic references sited in Shulchan Aruch (code of Jewish Law) have become arcane due to the change in how we as Jews live our lives. Here I am not referring to Toraitic (doreita) law, but many laws which are the product of the geonic (Babylonian exilic) period and forward. For example, according to Jewish Law men should not have heir hair cut by a non-Jewish barber. The reason for this law was made sense at one time, in particular in the middle ages, but no longer carries any value. Initially the law was instituted because in the medieval period, the barber was also the surgeon and licensed to practice blood letting. Blood libel was of major concern to the Jewish communities of Eastern and Central Europe and there was a question of Sacanat Nefashot (imminent danger), or perhaps Picuach Nefesh (life threatening circumstances) by having your hair cut by the local barber. The barber as a result of anti-Semitic feelings could cut your hair and at the same time cut your throat. So the rabbis, in their wisdom, instituted a Jewish law whereby men should refrain from having their hair cut by a gentile barber. I would assume that today many halachically centered Jews have their hair cut by gentile barbers. The law however is on the books and the obvious question is ought Jews be allowed to have their hair cut by a gentile since there is no question of imminent danger. If they can, then Jewish law forbidding a haircut by a gentile ought to be reevaluated, as well as many other laws. Many of the laws handed down to us originated during the geonic and medieval periods. Many of these laws were based on superstitious beliefs that were prevalent at the time. To be sure, when these laws were legislated, they were not seen as a response to superstition, but reacting to their cultural norms. Spirits and demons were considered real, and thus to be contended with. Concepts such as Ayin Harah, (evil eye) were as real to our ancestors as bacteria is real to us today. It was quite prevalent and part of the norm for people to seek protection through the use of amulets and charms. Rashi (French Rabbinic commentator and decisor during the early middle ages) was known to hang his tefilin on the bed post in order to protect his wife and unborn child from evil spirits. The mezuzah (amulet affixed to door post) was also perceived as a type of amulet. Many contemporary rabbis consider an improper mezuzah as the plausible reason why tragedy befalls a family. I would assume that most of us do not use tefilin in this same fashion because we do not believe that hanging tefilin from a bed post will do offer protection. I merely mention this as a way of demonstrating that norms change, and as a result the way we behave Jewishly changes as wellbut not with any consistency. There is a Jewish law that states that a corpse should optimally be buried the same day it expired. The reason commonly given is that it is out of our sense of kavod hames (respect for the dead). However, if we examine the practice, we will soon note that its origins were based on superstitions which are no longer relevant. It was believed in the medieval period that demons would do harm to the deceased, thus it was better to bury the deceased as soon as possible. Demons played a very significant part in of medieval Europe. There is much haggadic (folklore section of Talmud) discussion over even and odd numbers. There were many in the Talmudic period that believed that even numbers invited demonic attacks. Tosafot (commentary on Talmud-middle ages) in T.B. Pesachim discuss the merit of the fifth cup of wine as protection against demons. Naturally this has been masked with it being the Cup of Elijah, but the thirteenth century R.Samuel b. Judah Hazan speaks of the value of the fifth cup precisely to ward off the demons. Whereas the fifth cup of wine at the Passover Seder based upon superstition can be masked by calling it the Cup of Elijah, not so can we mask the tradition of Kapparot (waving a chicken as a sign of repentance) on Yom Kippur eve. The intent of the custom is to transfer the sins of the individual on to the fowl. Fowl happens to be closely associated with magic and the numbers three and seven are also part of magical rites. Hence the waving of the chicken seven times over your head. Other similar based customs is that of Tashlic (casting bread crumbs in the water on the first day of Rosh Hashanah) which is traced back to the Maharil in early fifteenth century Germany. The waters were believed to be a place where demons thrived and throwing bread crumbs to them was a way of placating the spirits. Spirits were very much a part of what fueled the psyche of a world seeking to make sense out of a world that they had little understanding of. The Havdalah service (Saturday night service using a candle, wine and spices to mark the termination of the Sabbath) was also fraught with concern over he spirits and the need to satisfy them through libations. Wine was poured on the ground as a good omen for the rest of the week. This originated in the Geonic period. During the Talmudic period the symbol of wine overflowing represented blessings already enjoyed. The Geonim did not like the custom of pouring wine on the floor but it nevertheless took hold. One final example is the custom sited in Shulchan Aruch for covering mirrors in the home of mourners. This custom emerged as an expression of fear that the soul projected out of the person in the shape of his reflection in the mirror might be carried off by ghosts of the departed, which is commonly understood linger about the house until burial. I am not suggesting that as a result of these reasons we should abandon our traditions, I t is important however, to understand how our rich tradition evolved, so that we can keep in perspective the practice of Jewish law. Your Lawn - Organic Weed Removal!

In order to prevent new weed growth, you should consider one of these methods: Soil Solarization - If you are starting with a bare lawn, meaning that you have built a house and are now trying to grow a lawn, you can try a method called Soil Solarization. Depending on how big your yard is, you may need to hire some help for a day or put your children to work. Soil Solarization is done by tilling the soil, removing all tree stumps and other growth including thatch, and raking the soil to pull up any weeds that are beneath the ground. In effect, you are cleansing the soil. See why you may need help? Relax! You do not have to do this for your entire yard. You can choose to use Soil Solarization just in those areas where you will be planting flowers and shrubs; this should cut down on the amount of your yard work. After you have tilled the soil and removed all sign of weeds, you should place landscape fabric on the area. Landscape fabric is a thin plastic sheet that will allow light, water, and nutrients into the soil, but will prevent new growth of weeds by not allowing the seeds to deposit in the area. You can find landscape fabric in any home garden supply store. You can also use black plastic garbage bags, but be forewarned that these bags will not allow a lot of sunlight or water though the soil and will retain too much heat. Once the landscape fabric has been positioned, you should secure it with cinder blocks or heavy rocks. Let the fabric sit for six to eight weeks. The sunlight will penetrate the fabric and literally fry any remaining seeds from weeds before they have a chance to grow. This is an easy, inexpensive way to reduce the number of weeds from the beginning. Bear in mind that like pesky in-laws, you will always have to deal with weeds. Taking steps like this one will help you reduce the number of weeds in your lawn considerably. Landscape fabric over existing plants If you already have plants and flowers on your lawn, but you want to protect them from weeds, you should first weed the area thoroughly. Remove all rocks, twigs, and other debris. Then you should lay landscape fabric down and cut holes so that you can push the plants and flowers through. Make sure the fabric is laying flat. This should prevent the growth of many new weeds. The next step for both methods is to lay mulch over the landscape fabric. This will provide nutrients for plants and flowers, but will not encourage weed growth as much as soil does. You have options when it comes to the type of mulch you want to use: Black plastic Stone mulches Organic material mulches You should only use black plastic as a last resort. Many people will use this instead of landscape fabric. But black plastic may end up harming your plants because of the amount of heat that is trapped between the plastic and the soil. Stone mulches will also draw in heat, but not as much as black plastic. Stone mulches will not decompose, but are hard to keep clean. This type of mulch will not provide many nutrients and will require more work on your part to keep your lawn looking its best. Organic mulches are the best type of mulch because even though it will decompose, its rate of decomposition is much slower when placed over the landscape fabric. Not only is it filled with nutrients and moisture, you can use your leaves and other debris from the yard to create the mulch. All you will need is a mulching machine.
